NOOR MUHAMMAD versus SAIFULLAH
The Constitution of Pakistan 1973 Article 199 dispute was only in relation to the supply of land occupied in the dispute which was to be auctioned. The applicants claimed that the land was already in their cultivating possession, while the department insisted that the land was vacant, according to the records. Land auction was not disputed by the parties; the authority had already been deployed to dispose of the land by public auction; it was directed that the fact of occupying this land be prevented if requested. If the winners are found occupying the land in dispute, if they succeed in the auction, the occupation will not be disturbed.
