Specific Relief Act 1877 Section 42 Discretionary Relief When a party was prevented from abnormal conduct, the question of title to the claim of the plaintiff was allowed at the request of the plaintiff, whereby he applied for a plot allotment. Was given and no plot value was fixed nor payment was made or payment was promised, therefore the claimant did not acquire any title to the plot nor convey the plot to the claimant. Had not been made nor was there any formal order to supply the occupation of the plot. Without waiting for the plot to be fixed, four walls were installed on the same wall, and thus the plaintiff was fully justified in the collapse in which the plaintiff found himself at discretionary relief under the provisions of section 42, Special Relief Act, 1877.
