The challan was pending before the Special Court Sessions Court. Under the Special Court under the Terrorist Activities (Special Courts) Act, 1975, the basis of some material was not yet formed and, therefore, no jurisdiction to bail the accused's crime was in the nature of a defamatory case. It had not yet been served in the proper order of the Sessions Court that the High Court had set aside the bail granted in the case on a charge of perverse.
