Land Disposal (Land Settlement) Act 1958 Section 10 (2) Constitution of Pakistan (1973), Article 185 (3), the land under which the land was sold to the respondents was declared as a house and Mukhtar was granted such land allotment. High Court justified. That the Settlement Authority was ineligible to provide allotments to the informants as the underground land was designated as a building site, through a notification on May 16, 1973, the High Court made a constitutional petition against the respondents. Allowed and separated the allotment in their favor. The High Court held that according to the report of 16 197 1973, there was no allotment of such land on the basis of the claimants / units, declaring the urban land within the municipal boundaries as as "urban or rural". The leave was denied under the circumstances
