ALLAH BAKHSH versus THE STATE
Section 302 Constitution of Pakistan (1973), Article 185 (3), leave of appeal was made in a public place and witnesses were presented to the accompanying witness, one person was injured in the same accident which had the option of substituting the offender. There was absolutely no reason. The following two courts had thoroughly examined the statements of witnesses and believed in their truth, which was free from any error of law or violation of the rule of law, such as further examination or justification. At the court level the evidence can be justified accordingly. The leave of appeal was denied accordingly.
