Sick could not submit the same rent controller, however, the tenant's defense was stopped by appellant Maintenance Landlord when he applied for a stay away from the tenant's defense, when the tenant received a medical certificate of fit and rent. Such request was objected to by the petitioner. One month after the landlord filed an application, nothing was found on the record as to whether any attempt was made by the tenant during any two months, when he was admittedly medically fit, the court Submitted the rent on the medical certificate indicating that the tenant was in distress. Had a fever but did not indicate that due to such illness, he was advised to rest in bed or that he was unable to move or move about in pursuit of his daily life. The tenant's appeal was not accepted due to illness for not submitting rent so he was unable to retain it.
