In Section 10 and 11 of the Land Grant Scheme, paragraph 4 of the Civil Procedure Code (v. 1908), the plaintiff contends that the plaintiff had premature possession of the land in which he was claiming ownership of the property in dispute. The suit acknowledged the respondents' title to the land. The plaintiff's grant was revoked on the basis that the landowner had filed a lawsuit against the seller of the land that the plaintiff had previously claimed to be the owner. The case with which the first appellate court properly dealt with and in fact confirmed the facts on record.
