The pre-trial trial hearing of the Punjab Pre-Emission Act 1913 Section 15 was heard on 29-11 1987. Wendy's appeal failed in the Appellate Court, but the High Court, in review, put aside both decisions about Sardar Ali's authority, reported as PLD 1988. SC 287 that no decree can be granted in pre-emption suit after 1986, on account of being co-owner of the estate. Given that the decision was not made and after a joint venture independently, such ground may still be available to him for a pre-emption claim. Any such request was either not mentioned in the appeal memorandum or mentioned in the decisions filed or in the other material in the record, if such was required, evidence that was not submitted at the appropriate stage. And there can be no basis for the remand of this case
