On the basis of the petition for leave to appeal the Constitution of Pakistan 1973 Article 185 (3), it was demanded that the High Court did not properly interpret the decision of the Supreme Court in Pir Khan v. Military Estate Officer, Abbottabad PLD 1987 SC 487. And this theory continues in the above decision. Now several other appeals were re-examined which were scheduled for hearing before a larger bench during the next month, which was discharged for appeal.
