Sindh Rented Premises Ordinance 1979 Section 13 Constitution of Pakistan (1973), Article 185 (3), was granted for leave to appeal the petitioners' argument that arbitration was used illegally in this case. And it was against the rules established by law. On the grounds that it cannot (i) exercise discretion against the law or legal principles. (ii) If the defense taken by the tenant is not proved or proved wrong, then there will be no question of arbitration in such case. (iii) if the tenant has been denied the right to recover the rent of the landlord, he will forfeit the right of discretion in his favor and (iv) use of the discretion only in favor of the tenant. May be shown when the tenant has sincerely tried to pay his obligations under the law
