Section 561A & 145 (4) of the Criminal Procedure Code (CCPC), the second magistrate on the telephone, directed the police officer to call the police officer to dispose of the section 145, contrary to the provisions of the CRPC. Fisher attached and tried unsuccessfully to hide his illegal order. The telephonic order passed by the magistrate, keeping this process unknown in writing throughout the Code of Criminal Procedure, was accordingly upheld, and the case was referred to the magistrate for action pursuant to the law.
