ILARN DIN versus HUSSAIN BIBI
The Special Relief Act 1877 Section 12 Constitution of Pakistan (1973), Article 185 (3) rejected the case for the claimant to enforce the contract of sale and cancel the sale in favor of the seller through the same vendors. The court was granted leave of appeal mainly because of its misrepresentation so that the questions raised in the application could be examined and whether there was an existing law such as Islamic law relating to the duties of vendors. Principles of Will not be attracted; if so, in the other case the application for permission was granted, after having already waived the appeal for the last question, the two cases had to be heard together.
