KHUDIJA KHANAM versus BORDER AREA COMMITTEE
The PAR-0 Constitution of Pakistan (1973), Article 185 (3), the land under which the respondents were initially allotted to the respondents but was abrogated and subsequently the High Court was allotted to the applicants in the constitutional jurisdiction. After the hearing, the reviewer received remand for the Border Area Committee, and the entire record examined, concluded that the allotment in favor of the respondents was illegal and deserved to be canceled, and that in favor of the applicants. The allotment was valid and should be upheld by the Border Area Committee decision in favor of the applicants. This Court set aside. The Court of Appeal allowed the consideration of whether the allotment in favor of the respondents was in accordance with the law.
