Whether or not the applicant was a tenant under the respondent? It was not disputed that he was paying rent to the previous landlord and sent a money order to the landlord to offer the rent. In response to the landlord's notice that he had sent to the applicant after purchasing the shop, the applicant had clearly admitted that he was occupying the shop as a tenant under the former landlord's rent. There was enough evidence to maintain a presence between the controller and the appellate court between the residential landlord and the tenant's parties. The applicant did not claim to have paid the rent request recipient. Thus the eviction was properly ordered that the leave of appeal be denied
