The Special Relief Act 1877 Section 42 Constitution of Pakistan (1973), Article 185 (3) allowed the appeal to consider that the mere fact that the declaration was not made was not grounds for denying the relief. And that it is appropriate in the circumstances of the Mold and Grant Relief case empowered by the Supreme Court to declare the transfer as ineffective, void and illegal, and also to pray for an alternative to the possession of the land granted by the applicant. ?
