Article 2302 Constitution Constitution of Pakistan (1973), Article 185 (3) The High Court acquitted the accused, saying that there was nothing in the record to show that the complainant knew the accused in the face even before the day of complaint. That since the complainant did not state that the accused was not known earlier, it would be assumed that he knew that the accused was allowed to examine the argument from face to face. There was no speculation in the circumstances of the case that the accused was seen for the first time and hence the identity was abandoned. The incident was presented in the light of day in which the accused was identified by the deceased's son.
