They will be returned to their positions which were rejected. The posting was against the posts of the ex-cadre and was on a temporary basis which cannot be regarded as ad hoc appointments, nor was the deputy authorized authority to pass an order under section 10 of the Act. And in NPS 17, the refusal of pay was according to the law. Appeal denied
