MAMOON versus STATE
Section 302 of the Constitution of Pakistan (1973), Article 185 (3) allowed the appeal to be examined as to whether the evidence by the defense revealed the deceased's role as well as the testimony of some witnesses. The absence of preparation and progress by the appellant, along with the circumstances of the attendant, including the conduct of the accused, will not indicate any overall reaction to the prosecution's case. Even if the defense could not be of any benefit to the defective character of the majority of witnesses. And even when the two sides are put together, the defense will still be deemed to have failed to create a reasonable doubt as highlighted in Safdar Ali v. Crown PLD 1953 FC 93.
