HARI KISHAN MEHRA versus CUSTODIAN, EVACUEE PROPERTY
Articles 2302 and 5 325 Constitution of Pakistan (1973), Article 185 (3) complainants' plea that the High Court did not point to the accusation of wounds inflicted on the victim by the accused. Does not indicate his intention to kill. Looking at the dimensions, it appears that the suit used by the accused was not thin wood. The injuries were mostly located on the head and neck. At the time of his death, his death was 60/65 years. In view of the fact that the accused had repeatedly hit an elderly man on the head and neck, his intention to kill could easily be attributed. And, therefore, the High Court was not OK to acquit the accused under Section 302, the Code of Conduct, which requires consideration.
