At the time of his death, his death was 60/65 years. In view of the fact that the accused had repeatedly hit an elderly man on the head and neck, his intention to kill could easily be attributed. And, therefore, the High Court was not OK to acquit the accused under Section 302, the Code of Conduct, which requires consideration.
