ROTHAN BACHER PETER versus THE STATE
The Customs Act, Sections 156 (1) (8), 158, 159 and 160 of the Customs Act 1969 were convicted of smuggling foreign-born heroin and sentenced to have been recovered from their rectum. The Gazette Officer of 's was not informed of his right to be taken. There is no compelling evidence to admit that the heroin seized was foreign before the personal search was neither conducted nor exhibited nor X-rays, the accused being transported from Peshawar to Karachi. He was planning to take a domestic flight from where he was to Nepal, the possibility that he could dispose of heroin in Karachi or used in some other way, could not be excluded. Neither was made according to the law nor did heroin prove the origin; no offense was proved under section (8) of section 156 (1), the circumstances were punished.
