The Powers Act violates Article 25 of the Constitution and the applicant was discriminated against in which the right of appeal was restricted to only one travel agency that had. Was licensed under section 4 of the Travel Agencies Act, 1976, as per the terms of section 2 (b) of the Travel Agencies Act 1976, did not hold any license, so he could not withdraw the right of appeal. Was set aside and the High Court directed the authorities to issue a license to the applicant according to the constitutional request granted.
