TARIQ MAHMOOD versus STATE
The complainant's case for transfer of the case to the Court of General Jurisdiction, Articles 302/324/148 and 149/341/506 of the Anti-Terrorism Act (XXVII of 1997), Section 6/7 Constitution of Pakistan (1973), Article 185 (3) Was suspended by. The accused, who has a lesser past than the terrorists and sectarian criminals, either had no personal motive for weakening the state or damaging rival factions, or against the innocent victims. In the case, it is admitted that there was a dispute on a piece of land between the parties before the incident so that there was no independent evidence on record to show that the act of the accused was causing terror among the people. The complainant denied the claim that the incident occurred in a market that had a large population and that criminal cases should be heard and the courts should decide until they have full jurisdiction. There were exceptional circumstances justifying the hearing of this case by the special courts. No interference was sought in the Improved Order. The complaint was refused accordingly.
