AYAZ KHAN versus STATE
Sections 302, 324 and 337F (i) Constitution of Pakistan (1973), Article 185 (3) were the case of a single accused who was accused of firing effectively on key sections of the deceased, repeatedly having no ocular version. He had no enmity with the accused nor had any relation with the victim nor natural witnesses as the incident occurred in his shop and the serious evidence of the accused was supported by ocular testimony, There was nothing on record to raise any suspicion in the prosecution's case. There was no mitigating circumstance to make the accused eligible for the minimum sentence but the leave to appeal was denied to the accused.
