Article 12 (2) and 115 of the Constitution of Pakistan (1973), Article 185 (3) In the initial period of litigation, it was decided to revise a consensus between the parties, which resulted in the petitioner taking possession of the suit property. The heirs of the deceased owner / allot, had agreed to make a legal extradition, but instead of doing so, the applicants filed an application under section 12 (2), objecting to the unanimous order and the High Court before the High Court. It was concluded that the petition filed under Section 12 (2) by the applicant is not authorized by the CPC. The High Court observed, however, that the previous proceedings arising out of the review, which were resolved by consensus among the parties, were correct.
