Sections 247, 403 and 561 of the Penal Code of Criminal Procedure (XLV of 1860), sections 506, 323 and 148 were acquitted on the grounds that the complainant was not present, hence the accused. Once acquitted, he was caught, could not be retried for a crime that was postponed.
