PROVINCE OF PUNJAB THROUGH SECRETARY, LOCAL GOVERNMENT AND COMMUNITY DEVELOPMENT, LAHORE versus BEZAD HAIDER KHAN

Respondents of the Section 3 Limitation Act (IX of 1908), the Section 5 Intra Court Appellate Litigation Office, raised the objection that the intra-court appeal was time-barred and that no petition for late condolences was filed. The case could not be excluded under the Limitation Act, 1908, from the date of raising the objections till the expiry of the proceedings, and the proper course for the appellant was to file a delayed concession while filing the objection. Subsequent confirmation of the appeal was disclosed on the notice board and the appellant was aware of the same intra-court appeal dismissed in the circumstances. Was rejected
