MAHMOODUL HASSAN ALVI versus SECRETARY, MINISTRY OF RELIGIOUS AFFAIRS AND MINORITIES AFFAIRS, GOVERNMENT OF PAKISTAN,ISLAMABAD
Section 8 (2) and 17 Constitution of Pakistan (1973), Article 199 of the Evaci Trust Properties (Management and Disposal) Act 1975 and the declaration of property to be a special evacuation trust property were declared by PTD after the earlier inquiry. The authority granted to the lenders was declared illegal, invalid and without any jurisdiction the order was fully investigated by the Constitution Petition and the property dealing with the immovable property was again such an order. Once approved, the authority cannot reopen this case. The revocation of such order cannot be interfered with the exercise of constitutional jurisdiction by the amending authority exercising the appropriate jurisdiction over an order approved nine years ago.
