FAQIR SAIN versus EXECUTIVE ENGINEER, M & T DIVISION WAPDA, GUJRANWALA
The West Pakistan Water and Power Development Authority Act 1958 Section 17 (1A) eliminates the controversial meter from appellant, a meter mechanic, and then supplies internal links to correct its speed on external links. The responsible assistant was handed over and under the direct supervision of the Test Inspector Meter, the two officers performed their assigned duties, after testing and re-calibration, but during the inspection of the senior officers an internal link was broken. And the meter was running slow which caused loss of revenue. The Authority was responsible for providing Appellant's external links, not the broken internally inspecting the test inspector's appeal, which was partly accepted by another Tribunal Bench. Instead of removing him from the job, he ignored it. The only inquiry officer mentioned in his report three reasons for the slowdown was the speed of the meter: (a) The linker was slowed down by a magnet while providing links. (b) that, during the transport, it slowed down. (C) that, during the course of the trial, the accused had deliberately reduced his speed to indicate that no instrument was available to identify the above three possibilities for reaching the decision of the appellant's involvement in the crime. , Plus the penalty for removing appellant from his job, the stringent tribunal partially accepted the appellant's appeal and directed that his salary be reduced instead of being removed from his job.
