Section 40 is allowed to appeal the petitioner's complaint that the presiding officer had invalidated some valid votes and, on the contrary, the petitioner's request to stop the publication of election results not approved by the Election Authority. In which the relief rejected by questions (i) of the High Court was dismissed. Whether the Presiding Officer was correct in rejecting or accepting certain ballot papers, and (ii) whether the Returning Officer was justified in deciding the election result, whether or not he was justified by the learned. But the election tribunal had to do that for which the applicant had already moved the applicants in the matter. The writ jurisdiction advised him to be ill at the High Court and he unnecessarily dismissed the Supreme Court and the High Court's request for leave to dismiss the appeal.
