HAKAM ALI versus MEMBER, BOARD OF. REVENUE
Section 12 Constitution of Pakistan (1973), Article 185 (3) under the provisions of the Martial Law Regulations allowed the respondent to appeal the finding of fact with surrendered land on the ground that the Government sold it on the basis that It has made part of its original allotment order. The applicant was occupying the disputed land and was never allotted nor exercised the option to buy it within a specified period, nor was it stable, by the Revenue Authorities and the High Court. It turned out that both of them were without substance, no interference was asked to dismiss the petition.
