SHAMIM ARA versus ABDUL QADIR
A IX, R 13 Constitution of Pakistan (1973), Arts 185 (3) and 199 Former Order, keeping the constitutional request in the matter of settlement, the respondent failed to appear and rejected the applicant's request. The party order was granted, contrary to which, the controversial leave appealed to consider the interdisciplinary argument that the applicant's absence before the High Court was neither deliberate nor negligent on his part. The reason and their reasonable explanation was not accepted by the High Court without legal justification.
