Section 13 Constitution of Pakistan (1973), Article 185 (3) dismissal was approved by the rent controller and the first and second appeals in respect of the property pending were filed in the partition suit. Against which no justification of the facts was made. Outside for interference by the Supreme Court, while rejecting the leave application, it is stated that the dismissal of the petition will not prejudice the pending trial before the Civil Court. Under the condition that if the tenant had not already emptied the premises, the aforesaid proceedings would not continue without vacating the premises.
