GHULAM ABBAS versus LAL DIN

Section 14A Pakistan (Administration for Equity Property) Act (XII of 1957), Section 22 Constitution of Pakistan (1973), Article 185 (3) Transferring a vacated land mortgage to pay for mortgage payment and improvement. Refusal to pay for applications was made on his ground of eviction by mortgage that he had not sought a statement from the Custodian High Court in this regard but refused to interfere with the jurisdiction of the writ because the claim was of unknown gross delay. It was later submitted that there was not enough ground to dismiss such a delay. The writ petition and the applicants, if they are entitled to compensation for the improvements, should have been allowed to do the same, though they did not receive any declaration from their subordinates in this regard, the petitioners were asked to suspend. Applied for compensation shortly after the due date. The court denied interference and denied leave to appeal
