Industrial Relations Ordinance 1969 Section 25A & 38 (3) Back Benefits Worker was dismissed on conviction and sentenced for negligence act when he was released from jail on approval of his departmental appeal. The order was withdrawn, however, because there was a period of absence from duty, the worker was treated as unpaid. The laborer claimed before the Labor Court that he was unemployed from the date of his dismissal to the date of his dismissal on the appeal of his department's appeal. It is not suggested that the worker has been employed elsewhere, so the benefits of retaining Labor Court orders are allowed to be retained, if the worker does not promise to claim a return. Then it is not barred from applying under section 25A of the Industrial Relations Ordinance. Benefits even if no claim was made in the Department of Appeal
