GHULAM FATIMA versus ADDITIONAL COMMISSIONER (REVENUE)
On the remand of the Displaced Persons (Land Settlement) Act 1958 S10 & S 11 case, the settlement commissioner's land was not inquired to confirm whether the Altaz / defendants purchased the land allotment by fraud. Is or not Was recorded by the Authority after proceedings under Sections 10 and 11 of the Act (XLVII of 1958) in which they ruled that the land allotment granted to them was valid and genuine and the claim was made by them on the property. Were moved legally. Refugees coming from the state of Jammu and Kashmir could not be canceled against their certified claims even after 5 years of their allotment, when the land was already excluded from the pool of compensation.
