The Civil Procedure Code of Order XXIII of the CPC was settled by agreement and legal agreement between the parties to the adjustment of suits OXXIII, R 3 & O XXXII, R 7 and section 100 according to which the appellant was. It is obliged to withdraw its appeal because the respondents had already withdrawn their case against the appellant respondents and performed their part of the agreement, it is alleged that the minors withdrew their claim and performed part of the deal. That is, the conditions for obtaining permission from the court under O XXXII, R 7, CPC shall be deemed to have been complied with by the court order permitting withdrawal of the case.
