HAKIM ALI versus THE STATE
The magistrate was remanded on the basis of the remand of the case by the Sessions Judge, Section 561A & 439A Penal Code (XLV of 1860), Sections 148, 452 and 307/149 of the Code of Criminal Procedure. His decision was based on speculation, that the advertising and misrepresentation of evidence resulting from the abortion of justice did not state which part of the magistrate's decision was based on a misrepresentation of evidence which resulted in the abrogation of justice. There was an abortion and which part was based on speculation, and the practice adopted by the trial session judge is strictly out of date. Returned to session judge for fresh verdict by law
