QARI ABDUL SHAKOOR versus ADDITIONAL SESSIONS JUDGE

Section 22A & 22B Panel Code (XLV of 1860), Section 354 Constitution of Pakistan, Article 199 Constitution Petition alleges that she intends to humiliate a woman. Police found that the FIR scope allegations leveled by the complainant during the investigation were baseless that the applicant / proposed accused had prepared a copy of the FIR filed by the complainant against some others. It appears that she was in the habit of making false accusations of assault to resolve disputes. The application for registration of the case was based on a serious motive. The Export of Justice was obliged to look into the matter for a moment and use the comments filed by the police to discourage the practice of registering cases because of outrage. On his particular facts and circumstances, the Executive Justice of Peace did not have to exercise the powers under Sec. Ons22A and 22B, CR PC passed the order for registration of the case in a mechanical manner and blindly applying false.
