Section 12 is the case for the specific performance of a contract to sell real estate that the plaintiff did not pay for the consideration and since the essence of the contract was timely, the plaintiff could not demand a specific performance, contract in that language agreement. As the essence of the case did not run out and when there was a contradiction of the defendants' claims and evidence, their defense could not be accepted, the court pressed by the High Court to fulfill the terms of the agreement. I had justified the plaintiff, dismissed the case. The court and ruled that the plaintiff is entitled to a specific performance order, in which case, an appeal is allowed
