MESSRS KAMRAN INDUSTRIES (PVT.) LTD. versus MIAN AHSAN ILAHI
The Appeal Court rejected the Company Court's disputed order of dispute between the shareholders of the Companies Act, 1913, section 162, after which the parties were compromised. Has filed an appeal against such consent order. The Company had no locus standi to file an appeal, as the Company was in dispute before the Court among the shareholders of the Company, but the Company itself was not a party to any of the proceedings by either of these parties. The appeal was not tiled against the order of the court petition. In the presence of the parties, even before the company is disposed of in the terms of the order of consent, the exception would not be open, the company had to follow the instructions given in the invalid order, against the order of consent. The appeal was ineligible, it was dismissed in circumstances.
