Criminal Procedure Code (V of 1898)‑‑

‑‑‑S. 497‑‑Penal Code (XLV of 1860) S. 325/34‑‑Bail‑‑Accused in jail for last three months, declared to be innocent and his name placed in column No. 2 of Challan‑‑Bail granted in circumstances .

JUDGMENT

The petitioner who has been arrested under section 325/34, P.P.C. and is in jail for the last about three months, seeks bail mainly on the ground that he has been declared innocent and that his name has been placed in column No. 2 of the challan.

Learned counsel for the petitioner has contended that the complainant had falsely involved him.

The statement of learned counsel that name of the petitioner has been placed in column No. 2 of the challan, has been verified by the learned counsel for the State.

Keeping in view the nature of offence, the period, since he is in jail, and also keeping in view the fact that he has been declared innocent and his name has been placed in column No. 2 of the challan, the petitioner is granted bail. He shall be released on bail provided he furnishes bail bond in the sum of Rs. ten thousand with one surety in the like amount to the satisfaction of the Assistant Commissioner, Jaranwala/trial Magistrate.
