The learned counsel for the complainant has produced a certificate issued by the D.S.P. (Legal) to the effect that an inquiry is being conducted against Muhammad Ahmad constable (Naib Court) on the allegation that he facilitated the escape of Jamal Din accused after the cancellation of his bail by the Sessions Court on 13-12-1986. It is submitted that the petitioner had escaped from Bakhshikhana after the bail was cancelled. My attention, has also been drawn to the medical report which states that the petitioner' is 'in no acute distress'. In the circumstances, the interim bail is recalled and this petition is dismissed.
