Criminal Procedure Code (V of 1898)--

-S. 498--Penal Code (XLV of 1860), S. 302/307/336/325/342/148/149- Bail, grant of--Petitioner allegedly escaped from Bakhshikhana, after cancellation of his bail-- Medical report showing that petitioner was 'in no acute distress'--Interim bail re-called, in circumstances.

ORDER

Jamal Din petitioner has not appeared. His learned counsel states that the case is fixed today before the learned Additional Sessions Judge and he is appearing in the said Court. The learned counsel for the complainant has produced a certificate issued by the D.S.P. (Legal) to the effect that an inquiry is being conducted against Muhammad Ahmad constable (Naib Court) on the allegation that he facilitated the escape of Jamal Din accused after the cancellation of his bail by the Sessions Court on 13-12-1986. It is submitted that the petitioner had escaped from Bakhshikhana after the bail was cancelled. My attention, has also been drawn to the medical report which states that the petitioner' is 'in no acute distress'. In the circumstances, the interim bail is recalled and this petition is dismissed.

I am informed by the learned counsel for the parties that eight P.Ws. have already been examined. The learned Additional Sessions Judge is directed to expedite the proceedings and dispose of the case as early as possible.
