MUHAMMAD ASHRAF versus AHMAD


The Pakistan Penal Code Sections & 2525 & Pro 323 Criminal Code of Conduct (v. 1898), amending Articles 435/459, sentenced the accused for not committing an unlawful fine, however, this is an insufficient record which shows that It is likely that the accused remained in jail before serving his sentence. When he was initially arrested by the police as a suspended and pending trial, after fifteen years, the request for a review was passed on to the parties entering the peace and peace, and neither party appeared before the court. Did not care to appear, the increase in punishment at such a stage was of no use.

---S.497--Penal Code (XLV of 1860), Ss.307/323--Bail, grant of- Accused involved in a case of free fight was admitted to bail.

ORDER

MAZHARUL HAQ, J.

-Trial Court came to the conclusion that it was a case of a free fight. Each accused was convicted for his criminal liability.

Jalali, petitioner was sentenced to seven years' R.I. under section 307 P.P.C. with a fine of Rs.10,000 in default to undergo six months' R.I. further.

Miru petitioner was convicted under section 323 PPC and sentenced to six months' R.I. with a fine of Rs.1,000 in default to undergo one month R.I. further.

Mubarak petitioner was also convicted under section 323 PPC and sentenced to six months' R.I. with a fine of Rs.1,000 in default to undergo one month R.I. further.

The three accused-petitioners are allowed bail in the sum of Rs.25,000 (Rupees twenty-five thousand) each with two sureties each in the like amount to the satisfaction of A . C /Duty Magistrate, D . G . Khan.

M.Y.H./J-14/L Bail granted.
