Criminal Miscellaneous No.1806/B of 1987, decided on 4th July, 1987.
---S.497--Offence of Zina (Enforcement of Hudood) Ordinance (VII of 1979), S.10--Bail, grant of--Case of petitioner at par with that of co-accused already allowed bail--Petitioner also allowed bail, in circumstances.
A.M. Sohail for Petitioner.
Rafi Siddiqui for the State.
The co-accused in this case was allowed bail and the case of the petitioner is at par with him. The perusal of the orders passed by the learned Additional Sessions Judge reveals that the bail was withheld on the, ground that her parents were not following the case
of the petitioner and if released on bail, she would again indulge simple life. Muhammad Iqbal, husband of the sister of the petition is present in Court and states that he is following the case of the petitioner and if she is released she will live with her sister. Considering the case from all angles and without expressing any opinion on the merits of the case, in my view it is a fit case for the grant of bail. Accordingly, I direct that the petitioner shall be released a bail provided she furnishes security in the sum of Rs.20,000/ (Rupees twenty thousand only) with one surety in the like amount to the satisfaction of A.C. /Model Town, Lahore. The surety shall be submitted by Muhammad Iqbal and after release of the petitioner she would live with Muhammad Iqbal.
