Articles 380, 440 and 447 of the Law Prohibition (10 of 1984), Article 129 (g) Criminal Code of Conduct (v. 1898), Section 417 (2A), appear before the trial court for record of the appeal against the eviction. In the absence of his statement, the complainant is making no attempt to appear before the trial court to summon the investigating officer. The court was obliged to include all relevant evidence, but this was not done and the witness (i.e., the investigating officer) was stopped in such circumstances. If the witness (i.e., the investigating officer) appeared in court, did not support the prosecution's case, the appeal against the defendants' verdict was dismissed accordingly.
