The decision, dated 30‑8‑1984 passed by the learned Presiding Officer, Punjab Labour Court No. 1, Labour has been challenged whereby the grievance petition of the appellant was dismissed on the ground that the grievance notice was time‑barred.
2. In the grievance petition the appellant did not disclose the date on which the grievance notice was served. The learned Presiding Officer, therefore, recorded the statement of the appellant on 30‑8‑1984. He stated that he was terminated from service seven or eight months before. He also stated that he had given the grievance notice on 24‑6‑1984. The learned counsel for the appellant has shown me a postal receipt but the same has not been placed on the file. The said receipt bears the date as 25‑6‑1984. The grievance notice was, therefore, time‑barred by more than three months. The notice should have been given up to 30‑11‑1983 but since it was sent on 25‑6‑1984 it was hopelessly time barred. The grievance petition was thus rightly dismissed. The appeal having no force is dismissed.
