‑‑S. 497‑‑Penal Code (XLV of 1860), S.377/511‑‑Bail, grant of‑‑F.I.R. lodged with delay of 5 days and no injury found on anal area of victim of sodomy‑‑Held: A case of further inquiry‑‑Petitioner allowed bail, in circumstances.

The petitioners are charged with an attempt to commit sodomy with Muhammad Yousaf on 30‑12‑1984.

2. Bail is claimed on the ground that that the case is based on absolutely false allegations, it was registered after a delay of five days and further that in the medical examination no injury was found on the anal area of the complainant. It is stated that he had picked up a fight with his age mates and the police got him medically examined on 20‑12‑1984 and a lacerated wound was found on the top of his head but the present case was got registered after five days' delay to implicate the petitioners on account, of a Warabandi dispute.

Keeping in view the above circumstances, it appears to be case of further inquiry. Accordingly, I admit the petitioners to bail in the sum, of Rs.10,000 each with two sureties each in the like ,amount to the satisfaction of the A.C./Duty Magistrate, D.G. Khan.
