KAMRAN versus STATE

The dismissal of section 497 (5) granted the petitioner's request that the trial court granted bail to the accused, regardless of whether there was sufficient evidence on record to link the case. That the trial court did not consider that the FIR was lodged on the day of the incident, the deceased was taken to the hospital and the dispute over the evacuation of arms recovered from the accused was issued before the notice of admission to the accused party. Was made and in the meantime a bail order was issued, the accused was suspended, but no release order was issued as the accused was not released till further orders.
