MEER HASSAN ALIAS AMEER HASSAN versus FEDERATION OF PAKISTAN THROUGH SECRETARY PORT AND SHIPPING, ISLAMABAD

Sections 42 and 54 Civil Procedure Code (v. 1908), OVII, R 11 Case of multiple claims denied of the plaintiff asserting that the plaintiff directed the authorities to execute the lease in favor of owning the plot. In the Prayer Clause based on the absence of cause for action, the plaintiff sought relief not only for the declaration that he owns the suit plot and direction for the execution of the lease deed but also for demolishing the structure on the suit plot. The plaintiff sought further direction for scrutiny and the Building Control Authority did not reject the construction project in accordance with the law. Even if a prayer was practicable, the plaintiff could not be rejected under OVII, R 11 CPC High Court denied the petition filed by the plaintiff in the circumstances.
