MUHAMMAD NASEER versus SAJID HUSSAIN

Section 17 (8) of the Constitution of Pakistan (1973), Article 185 (3) deferred the default order to tenants in rent arrears, which was interpreted by the controller of rent on the basis that the tenant had to collect the arrears of rent before. I have failed. The date the Pliyas raised by the tenant was that not collecting arrears before the due date was a straightforward mistake in translating the tenant's order, and could not be considered as default. The Court refused to accept the default interpretation given by the tenant because it would be very easy for each default tenant to accept the request that they be able to translate the rent control order into a larger one. Has been mistaken, if a particular order was to be submitted to this rent before the specified date, then either party will have to translate it. It is not right to do so. The Supreme Court did not find any ambiguity in the order passed by the Controller on Rent as it could not be interpreted. Otherwise the tenant was rightfully dismissed the appeal was denied.
